Court Dismisses Prince Oyowoli’s Case against Olu of Warri Kingdom

Olu of Warri Ogiame Atuwatse III

The Olu of Warri Ogiame Atuwatse III has recorded victory in the legal case over the Olu of Warri Stool succession battle instituted by Prince Oyowoli Emiko, son of former Olu, Ikenwoli.

The cas was on Friday dismissed by the Delta state High Court in Asaba, the state capital.

In a ruling, the court said, ” The respondent suit is statuted barred and therefore upheld the preliminary objection of the Applicants and the suit is dismissed in its entirety”

Highlight of ruling:

1. The main reason for withdrawing the suit w/104/21 was not borne out of a reason for a peaceful co-existence but to be presented another opportunity for a bite by filing this suit A/119/23.

2. The reliefs of the claim in this suit is premature.

3. The grievances of the Claimant ought to be presented during the 21 days period provided for by the S.19 of the Traditional rulers council chieftancy laws.

4. The letters of recommendation by the Executive Council came after the suit was filed as the time they filed this suit the recommendation letter were yet to be written.

5. This suit became a mere academic exercise by withdrawing the previous suit to file a fresh suit.

6. By so doing the claimants thought they could play a fast one but ended up shooting him self on the foot.

7. The Respondent suit is statuted barred.

8. I uphold the preliminary objection of the Applicants and this suit is dismissed in its entirety.
